El Tribunal Constitucional Federal alemán emitió el 5 de mayo de 2020 una larga y dura sentencia (2 BvR 859/15), que viene a contradecir y desautorizar la Sentencia del Tribunal de Justicia de la UE de 11 de diciembre de 2018 (C-493/17, Weiss; ECLI:EU:C:2018:1000). El Tribunal Constitucional Federal no duda en calificar de incomprensible, carente de sentido y, desde luego, ultra vires la decisión del Tribunal de Justicia y el modo en el que se produjo el razonamiento del Alto Tribunal europeo. Lo que está en cuestión en el fondo es el Programa de Compras de Activos del Sector Público (PSPP) del BCE y la propia capacidad del BCE y del SEBC para adoptar ese tipo de decisiones, que pueden exceder su competencia como reguladores de la política monetaria de la UE, para introducirse de lleno en el campo de la política económica. En este trabajo, pues, se analizan y comparan los razonamientos que justifican las respectivas decisiones judiciales y se evalúan sus consecuencias.

La salida del Reino Unido de la Unión Europea –el Brexit– es un grave problema que condiciona tanto la vida política como la dinámica económica de la Unión, pero también, en particular, la de sus Estados miembros. España, por su especial relación económica, y también humana, con el Reino Unido, es uno de los Estados de la UE que pueden verse más afectados por la salida del Reino Unido. Las Cortes Generales cuentan con un instrumento parlamentario para controlar la actuación del Gobierno en sus relaciones con la UE: la Comisión Mixta para la Unión Europea. Este trabajo pues, analiza con detalle cómo se han producido las relaciones Gobierno-Cortes en lo que se refiere al Brexit, tanto en sus aspectos jurídico-formales, como en sus aspectos materiales y políticos. Relaciones en las que la Comisión Mixta y el pleno del Congreso de los Diputados han tenido un papel fundamental. El trabajo, que cubre las Legislaturas X, XI y XII, incluye también un análisis de tipo cuantitativo y cualitativo de estas relaciones Gobierno-Cortes referidas al Brexit.
Abstract:The return to the European context, from which Spain was expelled after the end of the Second World War, has been the object of the ideological component and of the political project of almost all of the Spanish political forces for a long time. The admission of Spain into the European Communities, in January 1986, meant the realization of that ideological objective and political project. Since then, Spain experienced important changes that significantly improved its economic structure, but also other political and social aspects. All of these changes have been extensively described and analyzed by the specialized literature. This paper, however, tries to describe and analyze Spain's contributions to the European integration process at each phase of its development, and it does so departing precisely from a description of the political and ideological positions ofthe political forces of that period. This is something that has not been done so far, with the extension and interest that the subject deserves. ; Resumen:El reingreso en el contexto europeo, del que España fue expulsada tras el final de la Segunda Guerra Mundial, ha sido durante largo tiempo el objeto del componente ideológico y del proyecto político de la práctica totalidad de las fuerzas políticas españolas. El ingreso de España en las Comunidades Europeas, en enero de 1986, vino a suponer la realización de ese objetivo ideológico y de ese proyecto político. Desde entonces, España experimentó importantes cambios que mejoraron notablemente su estructura económica, pero también otros aspectos políticos y sociales. Estos cambios han sido descritos y analizados por la doctrina científica con todo detalle y extensión. Este trabajo, sin embargo, trata de describir y analizar cuáles han sido las aportaciones de España al proceso de integración europeo y su desarrollo en cada fase del mismo, y lo hace partiendo precisamente de lo que fueron los planteamientos políticos e ideológicos de las principales fuerzas políticas del momento. Cuando estaba a punto de cumplirse el 45 aniversario de su ingreso en las Comunidades Europeas, el Reino Unido decidió salir de la Unión Europea mediante el referéndum de junio de 2016. Entre un momento y otro ha habido una relación difícil; relación que ha tenido una dimensión muy positiva para las dos partes, pero también una dimensión negativa. Este trabajo trata de describir y analizar cómo se ha producido este proceso de relación del RU con las CCEE y con la UE, desde la solicitud de adhesión del RU, en agosto 1961, hasta el comienzo de las negociaciones sobre la separación de la UE, en junio de 2017.Almost 45 years after joining the European Communities, the United Kingdom has decided to leave the European Union following the referendum of June 2016. Throughout its membership, the two have shared a difficult relationship and despite there having been a very positive dimension for both sides, it is impossible to ignore the negative dimension. This article intends to describe and analyse how this process has taken place and how the relationship of the U.K. with the EECC and the E.U., evolved since the U.K.'s first application to join the EECC was submitted, in 1961, until the starting of the negotiations for the withdrawal in June 2017.

The UE is founded on a set of values which are mentioned in an explicit manner in Art. 2 of the TEU: respect for human dignity, freedom, democracy, equality, the rule of law and respect for human rights. Values which the same article states that are common to the Member States. Until now, the protection of these fundamental values is based on the mechanism foreseen in Art. 7 of the TEU. The existence of this mechanism though has not prevented the violation of these fundamental values by several of the Member States from taking place. This is why this article proposes the establishing of a new mechanism - the «Copenhagen mechanism» - which would be able to monitor the performance of the Member States on a permanent basis in order to prevent the violations from taking place, but which would also be able to impose the most serious penalties to the most serious violations of these fundamental values, including the expulsion of the UE. ; La UE se fundamenta en un conjunto de valores que son enunciados en el Art. 2 del TUE de manera explícita: el respeto de la dignidad humana, la libertad, la democracia, la igualdad, el Estado de Derecho y el respeto de los derechos humanos. Valores que el mismo precepto considera que son comunes a todos los Estados miembros. Hasta ahora, la protección de estos valores fundamentales se encuentra en el mecanismo previsto en el Art. 7 del TUE. La existencia de este mecanismo no ha logrado, sin embargo, evitar la vulneración de los valores fundamentales de la UE por parte de varios de sus Estados miembros. The European Union is going through a difficult crisis phase. It is a crisis that affects material aspects such as its economy and finances and, very specifically, the economies and finances of some of its member states; but it is a crisis that affects also immaterial aspect such as its own identity and the future of its political project. Many are the solutions that have been proposed in order to overcome this difficult stage, but in most of the cases these are inadequate solutions since they are not adapted to the peculiar nature of the EU as a legal and political organization. Therefore, firstly, this article analyzes the nature of the EU as a political organization and the different theories that have been issued in this regard. Secondly, the present situation of the EU is analyzed, including a perspective on what it is doing in this regard, and thirdly, the solutions to overcome this critical situation which have been proposed so far are also analyzed. ; La Unión Europea atraviese por una etapa difícil de crisis. Crisis que afecta a aspectos materiales, como su economía, sus finanzas y, muy en particular, las economías y finanzas de algunos de sus Estados miembros; pero crisis que afecta también a aspectos inmateriales, como su propia identidad y el futuro de su proyecto político. Muchas son las soluciones que se aportan para tratar de superar esta difícil etapa, sin embargo, en la mayoría de los casos se trata de soluciones inadecuadas porque no se adaptan a la naturaleza peculiar de la UE como entidad jurídico-política. Así, este trabajo, analiza, en primer lugar la naturaleza de la UE como entidad jurídico-política y las diferentes teorías que se han producido al respecto. En segundo lugar se analiza la situación actual de la UE y lo que ella hace al respecto, y, en tercer lugar se analizan las posibles soluciones que se aportan para esta situación crítica.The European Union is going through a difficult crisis phase. La Constitución de Cádiz de 1812 es el acta de defunción del Antiguo Régimen y el primer ejercicio práctico de soberanía nacional que inaugura la historia constitucional de España. Producto de unas Cortes revolucionarias que surgieron al calor de la rebelión del pueblo español contra el invasor francés e hija de un contexto revolucionario que se inicia años antes en Europa y América, la Carta Magna gaditana es una síntesis del ideario liberal del Nuevo Régimen constitucional y los elementos centrales del pensamiento conservador del despotismo ilustrado. Es el fruto de un acuerdo entre liberales y conservadores determinado por la imperiosa necesidad de dar una respuesta unitaria a la grave crisis política que afectaba a España en aquel momento. El presente artículo tiene por objeto enmarcar la Constitución de Cádiz en el contexto revolucionario de la época y analizar cómo la ideología liberal y los textos constitucionales que le precedieron influyeron en su formulación y contenido material.The Constitution of Cadiz of 1812 is the death certificate of the Ancien Régime and the first practical exercise of national sovereignty that starts the constitutional history of Spain. Product of a revolutionary parliament called amidst the rebellion of the Spanish people against the French invaders and daughter of a revolutionary context which begun few years before in Europe and America, the Constitution of Cadiz is a mix of the new liberal ideals and the conservative thought of the Spanish Illustration. It is the outcome of an agreement between liberals and conservatives forced by the urgent need to give an answer to the grave political crisis affecting Spain at that moment. The objective of this article is to put the Spanish Constitution of 1812 within the revolutionary context of that period and to analyse how the ideology of liberalism and the constitutional texts that preceded it influenced its formulation and substantial content.

Este artículo analiza las medidas de reforma adoptadas en el marco de la UE y de sus Estados miembros a efectos de introducir y consolidar en sus respectivos ordenamientos jurídicos el principio básico de estabilidad financiera o presupuestaria, conocido comúnmente como la "regla de oro "; es decir, la exigencia de que toda la administración pública, en sus diferentes niveles de gobierno, mantenga de manera permanente una situación presupuestaria de equilibrio o de superávit. Así, primer lugar, se analizan los precedentes en el Derecho constitucional comparado de esta exigencia constitucional y luego las reformas de los textos constitucionales realizadas en Alemania, España e Italia, pero también la frustrada reforma constitucional iniciada en Francia. y, en segundo lugar, se analizan las reformas en la gobernanza económica de la UE, realizadas tanto a través de documentos político-estratégicos, que establecen el marco general y los principios básicos de actuación, como a través de textos jurídicos que los desarrollan y aplican en la práctica. Así, el artículo analiza en detalle documentos político-estratégicos como el Pacto de Estabilidad y Crecimiento, Europa 2020, el Semestre Europeo, el Pacto por el Euro Plus; y las previsiones jurídicas del Art. 126 del TFUE y el procedimiento aplicable en caso de déficit excesivo; la reforma del Art. 136 del TFUE y el Mecanismo Europeo de Estabilidad; el paquete de seis medidas jurídicas conocido como "The Six Pack"; y la propuesta de nuevas medidas jurídicas de refuerzo en este terreno conocido como "The Two Pack". La entrada en vigor, el 1 de diciembre de 2009, del Tratado de Lisboa ha supuesto la superación de una de las etapas más largas y tensas de la historia de la Unión Europea. Una etapa que estuvo caracterizada por el surgimiento de grandes expectativas con respecto al cambio en la estructura y en los contenidos sustantivos de la UE y por el frustrante fracaso de las mismas que queda reflejado en el fracaso mismo de la Constitución europea. El resultado de este proceso ha sido la formulación de un nuevo Tratado —el Tratado de Lisboa— que viene a reformar los viejos Tratados hasta ahora vigentes y a establecer una nueva estructura constitucional en la Unión, con nuevos contenidos materiales, que tratan de superar lo problemas que afectaban a la UE entonces, pero también los nuevos problemas y desafíos que afronta la UE el presente. Este trabajo, pues, trata de analizar en detalle esa nueva estructura constitucional y las reformas aportadas por el Tratado de Lisboa.
